Terms of service

Client hereby accepts the following terms and conditions: This service contract is entered into by the Client and PETSIE Pet Sitting The upmost of care will be given to watching both your pet(s) and your home. However, due to the extreme unpredictability of animals, Petsie Pet Sitting cannot accept responsibility for any mishaps of any extraordinary or unusual nature (i.e. bites, furniture damage, accidental death, etc.) or any complications in administering medications to the animal. Nor can Petsie Pet Sitting be liable for injury, disappearance, death or fines of pets with access to the outdoors. This service contract shall apply from the date the Client accepts these Terms & Conditions, to and including the date until which all outstanding payments are made to Petsie Pet Sitting. In the event of an early return home, the Client must notify Petsie Pet Sitting promptly to avoid being charged for unnecessary visits. The fee for this service shall be the amount agreed by both parties, with Petsie Pet Sitting retaining the right to charge for additional fees if necessary. Any visits made or services performed in addition to those booked shall be paid for at an agreed contract rate. All prices are valid for ninety (90) days from the date of this contract. Thereafter, all prices are those prevailing at the time the contract is to be performed. Petsie Pet Sitting is authorized to perform care and services as outlined in this contract. Petsie Pet Sitting is also authorized by the Client to act as the Client’s agent to take such steps as Petsie Pet Sitting deems necessary to ensure the safety and security of the premises or animals in Petsie Pet Sitting’s care; seek emergency veterinary care with release from all liabilities related to transportation, treatment and expense. Should specified veterinary care be unavailable, Petsie Pet Sitting is authorized to approve medical and /or emergency treatment (excluding euthanasia) as recommended by a veterinarian. The Client agrees to financially indemnify and reimburse Petsie Pet Sitting for any steps whose cost are not part of the service fee designated above, including but not limited to expenses incurred in extension of service, feeding pet(s), additional visits, veterinary care plus any additional fees for attending to these needs or any other expenses incurred for any other home/ food/ supplies/ electrical/ plumbing or other emergency work deemed necessary by Petsie Pet Sitting in the absence of the Client. In the event of inclement weather or natural disaster, Petsie Pet Sitting is entrusted to use best judgement in caring for pet(s) and the home. Petsie Pet Sitting will not be held responsible for consequences related to such decisions. The Client is solely responsible for ensuring that all materials and equipment necessary for the provision of services and all necessary medications and equipment for maintenance of all pets living at the premises are available at the premises for the use of Petsie Pet Sitting in carrying out its duties under this contract. If the Client misrepresents or fails to comply with any of the terms or conditions herein, Petsie Pet Sitting may, at its option, give two (2) days’ notice of intention to cancel this contract without any obligation or damages on the part of Petsie Pet Sitting. Petsie Pet Sitting reserves the right to terminate this contract at any time before or during its term if Petsie Pet Sitting, in its sole discretion, determines that the Client’s pet possesses a danger to the health, well being or safety of a Petsie Pet Sitting representative. If concerns prohibit Petsie Pet Sitting from caring for the pet, the Client authorizes the pet to be placed in a kennel, with all charges there from to be the responsibility of the Client and charged to the Client. All pets are to have up to date vaccinations including but not limited to rabies, distemper, leukemia. Should a Petsie Pet Sitting representative be bitten or otherwise exposed to any disease or ailment received from the Client’s pet(s) which has not been properly and currently vaccinated, it will be the Client’s responsibility to pay all costs and damages incurred by the victim. Petsie Pet Sitting agrees to provide the services stated in this contract in a reliable, caring and trustworthy manner. In consideration of these services and as an express condition thereof, the Client expressly waives and relinquishes any and all claims against Petsie Pet Sitting except those arising from negligence or wilful misconduct on part of Petsie Pet Sitting. The Client represents and warrants that the Client’s premises are currently, and during the term of this contract, covered by a comprehensive insurance policy for property damages and personal injury and agrees that Petsie Pet Sitting is and will be released from all liability related to any hazard, peril or event covered by such insurance. Specifically, the client agrees that Petsie Pet Sitting is not liable for any loss, damage or injury, including but not limited to, soiling or damage of carpets, furniture or fixtures, caused directly or indirectly, by any pet (animal, bird, fish, etc.) residing in or visiting the Client’s premises while such premises are under the care or control of Petsie Pet Sitting. In the event of loss or damage, however caused and by any nature whatsoever, by Petsie Pet Sitting or its employees or representatives, the Client agrees to report such loss or damage to Petsie Pet Sitting within three (3) days after Petsie Pet Sitting has ceased to provide services under this contract. If loss or damage is not so reported Petsie Pet Sitting, its directors, officers, employees and /or representatives shall not be liable for any such loss or damage. If loss or damage is so reported, the liability of Petsie Pet Sitting. shall be strictly limited to the amount of any consideration received by Petsie Pet Sitting for payment of the contract price. Petsie Pet Sitting is not liable for any loss, damage or injury of any nature whatsoever caused directly or indirectly by any person who is not an officer, director, employee or representative of Petsie Pet Sitting who visits or resides in the premise at any time while such premises are under the care and control of Petsie Pet Sitting. The Client understands this contract also serves as an invoice and takes full responsibility for prompt payment of fees upon completion of services contracted. A finance charge of 28% per year will be added to unpaid balances after 30 (30) days. A handling fee ($25) will be charged on all returned cheques. One-half deposit (50% of total fee) is required on lengthy assignments (services hired for 10 days or more) and first time clients or clients with a history of late payment will be required to pay in advance before services are rendered. In the event it is necessary to initiate collection proceedings on the account, the Client will be responsible for all attorney’s fees and costs of collection incurred by Petsie Pet Sitting. There are no verbal agreements which are part of this contract. The terms and conditions of this contract may not be changed except by an additional written agreement executed by the Client and by Petsie Pet Sitting. The Client represents and warrants that the Client is over the age of 19 years of age and has full capacity to enter into and perform this contract. In the event of cancellation of this contract for any reason, or in the event of any breach thereof, the Client shall remain liable for any damages and any loss of profits incurred by Petsie Pet Sitting together with reasonable legal fees, costs and disbursements, and any deposit made hereunder shall be retained by Petsie Pet Sitting. If Petsie Pet Sitting does not or cannot, for any reason whatsoever, provide the services contemplated by this contract, Petsie Pet Sitting’s liability shall be limited to refunding payments received from the Client in respect of such services. In the event that Petsie Pet Sitting is required to employ a locksmith to gain entry into the Client’s premises due to a malfunction of the lock or failure of the Client to leave a key, it shall be the responsibility of the Client to reimburse for all costs incurred. The Client expressly gives Petsie Pet Sitting to authority to employ a locksmith on the Client’s behalf in the event of the aforementioned circumstances. The Client authorizes this signed contract to be valid approval for future services of any purpose provided by this contract permitting PetsiePet Sitting to accept telephone or email reservations for service and enter premises without additional signed contracts or written authorizations. By booking with Petsie, you accept that your pet may be featured on our Instagram page @HeyPetsie. All client information is kept confidential and no sensitive information is ever displayed on our social media without your prior consent. Representative Please note that your scheduled Petsie visit may be conducted by any of our Petsie representatives. We maintain professionalism, the highest standard of caregiving and quality service throughout our visits and during your entire experience with Petsie. We are proud of our Petsie team and are confident in our representatives. If you would like to request a specific member of our team to conduct the visit with your pet, please contact info@heypetsie.com we will try to accommodate your request but this is subject to availability and scheduling. Vet Expenses Before booking with Petsie, you MUST have a valid credit or debit card registered with your vet, or an agreed payment plan/insurance/account with your vet. Petsie cannot be responsible for any expenses associated with medical treatment, veterinarian examinations, diagnosis, tests, recommended diet change and/or prescriptions. Any out of pocket expenses Petsie has to cover will be billed to the client with an additional administration fee and relevant interest rates will apply. Please book at least 48 hours in advance. Petsie cannot guarantee that we will be able to fulfill your booking if we have less than 48 hours notice. In the event that the Client authorizes and requests Petsie Pet Sitting to allow/provide their pet(s) outdoor access at any time during the contract period, the Client agrees that Petsie Pet Sitting is not liable for any loss, damage or injury to the pet(s), including but not limited to, loss or non-return to the Client’s premises, physical injury, illness or death of a pet(s). Animal Welfare In the interest of animal welfare, Petsie is recommending the following pet sitting visits as a minimum requirement: 1. Pets over 2 years old: 1 x 1 hour visit every 24 hours; 2. Pets over 12 months but under 2 years old: 2 x 1 hour visit every 24 hours; 3. Pets under 12 months old: 3 x 1 hour visit every 24 hours. Should Petsie be concerned about the wellbeing of any animal in its care, we reserve the right to remove that animal from the place they are being contained to a safer alternative, with all associated costs being charged to the owner. While we understand the convenience of automatic feeders, pets need human contact and stimulating environments to maintain their wellbeing. A healthy pet is a happy pet.
